Making a contract with us

When you select the goods which you wish to purchase and complete your details and submit them to us by clicking the "Make the Order" button you are offering to purchase these goods at the price shown on the Website subject to these terms and conditions.

The contract for the sale by us to you of the goods is completed when we send to you our confirmation of order by email.

In order to buy goods from us through this website you must be at least 18 years old. We reserve the right at our discretion to refuse to complete a contract for the sale of goods to you.

Prices

All prices advertised are inclusive of GB VAT at 20%.

Payment

Payment is made by credit or debit card or by mailing a cheque with letter including full name and address to our contact address detailed above.

If you choose to pay us by credit/debit card you will automatically be transferred to the Sage Pay VSP secure server. Sage Pay will process your card payment transaction in a highly secure environment using 128 bit SSL Encryption. Sage Pay is a fully approved payment processor with all major UK acquiring banks. At no stage are your card details notified to us. Upon completion of your payment, you will automatically return to our website.

Delivery

Once your order has been confirmed by us and payment completed, your Goods will be despatched to you as soon as possible. Customers will be contacted by email if their order cannot be dealt with within this time. If for whatever reason the Goods which you have ordered are not available, we will inform you as soon as possible.

Delivery of Goods will be to UK addresses only, including the Channel Islands and the Isle of Man. Delivery times are not guaranteed, in particular deliveries to Scottish Islands can take longer than the stated durations. If delivery is delayed due to any cause beyond our reasonable control, we will contact you to make an alternative arrangement for delivery.

We offer the following delivery options:

Our Standard Delivery is by Royal Mail Recorded Delivery Second Class (except some parcels small enough to be classified as Royal Mail large Letter size which are sent by Royal Mail First Class). The cost of Standard Delivery is £3.95. Orders of greater value than £100 can only be sent by our Express Next Day Delivery Service. The cost of Express Next Day Delivery is £6.95 for orders totalling above £100 and up to £150, £9.95 for orders totalling more than £150 and up to £850 and £45 for all orders totalling greater than £850.

If goods are in stock we aim to despatch all orders received by 12:45pm on a working day (which excludes weekends and Bank Holidays) the same day and delivery will be in 3-5 working days thereafter under our Standard Delivery service. Heavier Standard Delivery orders may be sent by a service other than Royal Mail Recorded Delivery.

Express Next Day Delivery is sent by Royal Mail Next Day Special Delivery or for larger or heavier items Business Post Next Day. We aim to despatch orders received before 12:45pm under this service (on a working day) so that they arrive the next working day.

Customers should contact us regarding the availabilty of Cytronex bikes and if delivery of a bicycle is required this will be sent by Business Post at a cost of £45.

Customers may also choose to pick up their order(s) from our showroom at 5 Red Deer Court, Elm Road, Winchester, SO22 5LX in which case no delivery charge is incurred.

If your order has not arrived after the following period please contact us as soon as possible, by emailing customerservices@moderntimesltd.com: Express Next Day Delivery – 4 working days, Standard Delivery – 8 working days (which exclude Saturdays, Sundays and Bank Holidays).

It is important to remember that many of the items we sell will not fit through a letterbox and most of our delivery services require a signature.

If goods have been damaged in transit please notify us immediately.

Cancellation of Orders and Returns

In accordance with distance selling regulations, you have the right to cancel your order for up to 7 days after the day of delivery.

To cancel your order, you must notify us by email or in writing to our contact address within this 7 day period. You do not have to give any reason for cancellation. However, a brief explanation will help us to improve the service we offer to customers in the future.

If you cancel your order you must take good care of the goods and must return them to us promptly at your own expense by signed for delivery service with adequate insurance. The goods must be returned to us in resalable condition, with all packaging and seals intact and all fittings and guarantees enclosed.

If the Goods have been damaged whilst in your possession then you will be liable for the cost of repairing that damage.

A refund of any monies paid by you to us for the goods will be made within 30 days of your cancellation provided the goods have been received by us and found to be in resalable condition. If you have paid for the price of the goods by credit or debit card, your credit or debit card account will be re-credited as soon as possible and in any event within the above 30 day period.

Damaged or Faulty on Delivery

You have the right to return a faulty item within a reasonable period of time. Please keep all the warranty information that accompanies your item as this may be needed should there be a fault. In the unlikely event that you have a faulty item, please email us as soon as possible at customerservices@moderntimesltd.com or write to us at the contact address above and we will contact you with the returns procedure.

Product Warranty

All of our supplied Goods have a manufacturer supported warranty. Should your product fail within this period please notify us at customerservices@moderntimesltd.com. We will advise on the specifics of the manufacturer warranty and, as appropriate, repair and return the Goods to you or deliver replacement Goods to you. In some cases the manufacturer provides a direct warranty repair service which may save you time, but you are entitled to return the goods to us. Cytronex products must be returned to us. Faulty goods must be returned at your own expense by a signed for delivery service with adequate insurance, unless they are found faulty on delivery and notified to us as such within 7 days by email or letter.

Please note that certain parts of Goods are considered as consumable items by the manufacturer. As such damage or deterioration in normal use, such as may be expected with rechargeable batteries, may not be covered. See manufacturer's warranty for details.

Changes to these Terms

These terms were last changed on 20th January 2009.

These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

Extent of Liability

We make every effort to ensure that goods advertised for sale on the Website are described accurately. However, the descriptions of goods on the Website do not form part of the contract between you and us. They are designed to represent a general idea of the Goods. You should ensure that the goods which you are purchasing from us are suitable for your intended purpose. We do not give any warranty that the Goods, which you purchase from us, are suitable for your intended purpose.

We will not be liable to you for any loss or damage which you suffer as a result of any breach by us of this contract, including, but not limited to, consequential loss to you and/or loss or damage to the property of third parties. In any event our liability to you arising directly from our negligence will not exceed the invoice value of the Goods. Nothing in this clause will limit our liability for death or personal injury resulting from our negligence. This clause does not affect your statutory rights.

We make every effort to ensure that this Website is free from viruses or defects. However, we cannot guarantee that your use of this Website or any website accessible through it will not cause damage to your computer. It is your responsibility to provide adequate protection for your equipment which you use to access this Website. We will not be liable to you or to anyone else for any loss or damage which may be caused to any equipment arising as a result of your use of this Website.

Law and Jurisdiction

The contract shall be governed by English law and we and you consent to the exclusive jurisdiction of the courts of England and Wales. If you access the Website from locations outside of England and Wales you are responsible for complying with any laws applicable to that territory.

Privacy & Security

We are committed to protecting the privacy of our customers. It is our intention to operate and only to use the information provided by you in accordance with the provisions of the Data Protection Act 1998.

We do not sell on information to third parties. Personal information (e.g. name, address, telephone number, email address) provided by you will be used only for the purpose of completing your purchase, services related to your purchase and if you choose to receive it - the occasional emailed offer which we think you may be interested in (for example, a special offer on brush heads for those who have purchased electric brushes).

We will not disclose any of your personal details to a third party unless authorised by you, or we are required to do so by law.

You can recycle your old Cytronex Batteries with us.

Why recycle?

Unwanted electrical equipment is the UKs fastest growing type of waste.

Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.

Under the Waste Battery Regulations, Modern Times Ltd are offering a take back scheme. You can return your waste batteries to our business premises in person (please do not post). Alternatively, you can find your local waste battery recycling facility at www.recyclenow.com.
