Making a contract with us
When you select the goods which you wish to purchase and complete your details and submit them to us by clicking the "Make the Order" button you are offering to purchase these goods at the price shown on the Website subject to these terms and conditions.
The contract for the sale by us to you of the goods is completed when we send to you our confirmation of order by email.
In order to buy goods from us through this website you must be at least 18 years old. We reserve the right to decline to enter into a contract for the sale of goods to you.
All prices advertised are inclusive of GB VAT at 20%.
Payment is made by credit or debit card, excluding American Express. We do not accept cheques.
If you choose to pay us by credit/debit card you will automatically be transferred to the Sage Pay secure server. Sage Pay will process your card payment transaction in a highly secure environment using 128 bit SSL Encryption. Sage Pay is a fully approved payment processor with all major UK acquiring banks. At no stage are your card details notified to us. Upon completion of your payment, you will automatically return to our website.
Deposit for C1 kit
Paying the deposit of £99 means you are entering into a purchase contract with Modern Times Ltd for a Cytronex C1 kit - full price £945. The deposit is for the administration costs in the necessary processing and preparation of your bespoke order which happens within 14 days of you placing your deposit, even if we are unable to supply straight away. After 14 days the deposit is non-refundable unless at the express discretion of the company. If you wish to cancel your order please use the Support Contact Form or write to Cytronex, 7 Bridge Street Winchester SO23 0HN within 14 days of placing your deposit. It must be made clear that you are cancelling the order and why and request the refund. The refund would be made within 14 days to the card you paid by.
The balance of £846 (full price of kit less deposit) is due on confirmation by email from us that we are ready to build your order and supply, and is required within 14 days of any such confirmation, together with payment for any other accessories on your order. If you fail to supply full payment when requested Modern Times Ltd reserves the right to cancel your order and your deposit is forfeit.
Please note we are currently taking deposits from non-UK customers albeit we cannot currently give delivery times or prices for items that need transporting outside of the UK, so customers from EU and further afield are recommended to use the Enquiry Contact Form for estimated supply times.
Delivery is chargeable according to the size of your order and where it is being despatched too, this will be confirmed at the time of paying the balance of the order. Once your order has been confirmed by us and payment completed, your Goods will be despatched to you accordingly - usually within 14 days (please note Cytronex is a bespoke product which is made to order). Customers will be contacted by email if their order cannot be dealt with within the timings given. If for whatever reason the Goods which you have ordered are not available, we will inform you as soon as possible.
Delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, we will contact you to make an alternative arrangement for delivery. A signature is required for delivery.
If your order once confirmed as despatched, has not arrived after 14 days (UK mainland) or 21 days (elsewhere) please contact us as soon as possible.
If goods have been damaged in transit please make sure you tell the courier immediately and record it with them at time of delivery, ideally taking a photograph. Then please notify us immediately by email email@example.com or phone +44 (0)1962 866122.
Cancellation of Orders
Cytronex C1 is a bespoke product tailored to your bike from the information you supply at the time of order. You therefore do not have a statutory right to change your mind after placing the order, however if you make a mistake with any of the information or wish to change your order, you must contact us immediately. We reserve the right to make an additional charge in the event that it's still possible to change an order detail, to cover any extra costs incurred our end. This is entirely at our discretion and does not affect your statutory rights.
Damaged or Faulty on Delivery
If goods have been damaged in transit i.e. packaging damaged, please make sure you tell the courier immediately and record it with them at time of delivery, ideally taking a photograph or in other ways evidencing the damage. Then please notify us immediately by email firstname.lastname@example.org or phone +44 (0)1962 866122.
You have the right to return a faulty item for a refund or replacement within 30 days of receipt, after that and within 6 months we will do our best to repair or replace a faulty item. Please keep the warranty information that accompanies your item as this may be needed should there be a fault. In the unlikely event that you have a faulty item, please email us as soon as possible at email@example.com or write to us at the contact address above and we will contact you with the diagnostic and returns procedure as relevant. Please do not send us back any items until we have asked you to.
Cytronex C1 is warrantied for a year, with the battery being warrantied for 12 months or 300 recharges whichever is the sooner. This warranty depends on the customer following advice in the manual supplied at the time of purchase. This is an electronic product and so must be looked after with care and stored appropriately when not in use. The warranty is not transferable from the original owner. When out of warranty there is a diagnostic service available for which there is a charge. Any bicycles and other products sold by us are also covered by a manufacturer's warranty so please keep all warranty documents safe. Other items supplied by other manufacturers may be considered consumable items. As such damage or deterioration in normal use, such as may be expected with rechargeable batteries, may not be covered. See manufacturer's warranty for details.
In the case of all issues with the performance of your purchase please contact firstname.lastname@example.org or call us on +44 (0) 01962 866122 as soon as possible. Do not send us back any items until we have asked you to, and advised you of our returns procedure.
You are responsible for packaging up safely and securely any products that need to be returned to us, in accordance with our advice, and otherwise following our returns procedure.
Changes to these Terms
These terms were last changed on 19th September 2016. These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.
Extent of Liability
We make every effort to ensure that goods advertised for sale on the Website are described accurately. However, the descriptions of goods on the Website do not form part of the contract between you and us. They are designed to represent a general idea of the Goods. You should ensure that the goods which you are purchasing from us are suitable for your intended purpose. We do not give any warranty that the Goods, which you purchase from us, are suitable for your intended purpose.
We will not be liable to you for any loss or damage which you suffer as a result of any breach by us of this contract, including, but not limited to, consequential loss to you and/or loss or damage to the property of third parties. In any event our liability to you arising directly from our negligence will not exceed the invoice value of the Goods. Nothing in this clause will limit our liability for death or personal injury resulting from our negligence. This clause does not affect your statutory rights.
We make every effort to ensure that this Website is free from viruses or defects. However, we cannot guarantee that your use of this Website or any website accessible through it will not cause damage to your computer. It is your responsibility to provide adequate protection for your equipment which you use to access this Website. We will not be liable to you or to anyone else for any loss or damage which may be caused to any equipment arising as a result of your use of this Website.
Law and Jurisdiction
The contract shall be governed by English law and we and you consent to the exclusive jurisdiction of the courts of England and Wales. If you access the Website from locations outside of England and Wales you are responsible for complying with any laws applicable to that territory.
Privacy & Security
We are committed to protecting the privacy of our customers. It is our intention to operate and only to use the information provided by you in accordance with the provisions of the Data Protection Act 1998.
We do not sell on information to third parties. Personal information (e.g. name, address, telephone number, email address) provided by you will be used only for the purpose of completing your purchase, services related to your purchase and if you choose to receive it - the occasional emailed offer which we think you may be interested in (for example, a special offer on brush heads for those who have purchased electric brushes).
We will not disclose any of your personal details to a third party unless authorised by you, or we are required to do so by law.
